Fiscal residence

When you have residence in Andorra, you can live in the Principality officially and formally, but it does not give you the right to obtain Andorran tax residence to pay taxes in the country when they come from worldwide income. Individuals only have tax residence in a single country, but can simultaneously have residence permits in different countries during the tax year.

To define and determine which is the country in which a natural or legal person is resident for tax purposes, we must assess some criteria that define that person's tax residence. These criteria are based on the OECD model and are as follows:

  • Be a tax resident in the State, territory or jurisdiction for a minimum period of 183 days, or where the person has their permanent home.
  • If you do not comply with any of the previous points, you will be tax resident where you have the center of economic interests.
  • In the case of not fulfilling any of the other points, he will be tax resident where he has his center of vital interests such as the residence of his family nucleus.
  • If, at this point, you still do not meet any of these criteria, you will be assessed where you usually stay.
  • The criterion of nationality is valued.

And finally, if none of the aforementioned criteria is met, an agreement is attempted by both parties.

Deposit to the Andorran Financial Authority (AFA)

The Andorran authorities have recently established that when making foreign investments, with the permit to work on your own account as a company administrator, and for passive residence permits, a deposit must be compulsorily deposited in the'Financial Authority of Andorra (AFA).

This amount that must be paid to the Financial Authority of Andorra can be a problem when deciding to invest and live in the Principality of Andorra. But this amount is fully recovered without any problem once you deregister in the Principality of Andorra. The only drawback you may encounter in returning this bond is if you have debts with the Andorran administrations or similar.

This bond has been established in the country due to the large number of problems due to false self-employed persons and natural or legal persons who left their residence in Andorra leaving debts to the administrations. In order to combat this problem, it was decided to make this bond mandatory to demonstrate the commitment of new residents in the Principality of Andorra.
